German court allows Muslim teachers to wear headscarf, declaring Berlin headscarf ban illegal

Germany’s Federal Labor Court has ruled that it is unconstitutional to impose a ban on teachers wearing headscarves in schools in the capital, Berlin.

The German federal court’s decision is the latest in a long legal battle involving a Muslim woman who was banned from attending a public school in the city.

The federal court ruled that the woman was “discriminated against on the basis of her religion.” Following the court’s ruling, some lawmakers have called for changes to Berlin’s controversial neutrality law.

The ruling comes in the case of a Muslim woman who was barred from working as a teacher in the city’s government schools for wearing a headscarf. The woman was told in a job interview that she would not be allowed to teach in Berlin’s schools if she continued to wear a headscarf. She then took her case to the Labor Court in Berlin-Brandenburg.

Berlin’s neutrality law prohibits any government employee from wearing religious clothing or emblems, and teachers are not allowed to wear headscarves. The court ruled that wearing a headscarf could only be banned if there was strong evidence that it could disrupt school peace.
